1. Acceptance of Terms
Welcome to Zidly, a digital tipping platform. These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and related services. By creating an account, accessing, or using Zidly, you agree to be bound by these Terms and acknowledge that you have read, understood, and accepted them.
If you do not agree to these Terms, please do not use Zidly. These Terms apply to all users, including service professionals, businesses, and customers. We may update these Terms at any time, and your continued use of Zidly after changes are posted means you accept those changes.
2. Use of Services
Zidly provides a platform for cashless tipping and peer-to-peer microtransactions. You may use the Services only for lawful purposes and in accordance with these Terms. You must comply with all applicable laws and regulations when using Zidly.
- Permitted Use:
- You may use Zidly to send and receive tips, access your transaction history, and manage your account settings.
- Payment Terms:
- Tips are voluntary, non-refundable once successfully sent, and processed in KWD. Zidly charges a small platform fee plus payment-network costs; the breakdown appears on the checkout screen before the tipper confirms.
- Availability:
- We strive to keep Zidly available, but we do not guarantee uninterrupted access and may perform maintenance, updates, or suspend the Services at any time.
3. User Accounts
You must be 18 or older to receive tips. You are responsible for the activity on your account, the accuracy of the information you provide during KYC, and keeping your phone, email and bank details up to date. You must also keep your account credentials confidential.
We reserve the right to suspend or terminate any account if we suspect unauthorized access, false information, or activity that violates these Terms.
4. Intellectual Property
Zidly and its licensors own all rights, title, and interest in and to the Services, including all software, trademarks, logos, and content provided through the Services. These Terms do not grant you any license to use the Zidly brand or intellectual property except as required to use the Services as permitted.
You may not copy, modify, distribute, sell, or exploit any part of the Services for any commercial purpose without our prior written permission.
5. Prohibited Conduct
You agree not to use the Services in any way that could harm, disable, overburden, or impair the Services or interfere with anyone else's use of the Services. You may not attempt to gain unauthorized access to the Services, other accounts, or systems connected to the Services.
Prohibited activities include, but are not limited to: scraping or crawling the Services; using the Services for fraudulent or illegal purposes; sending spam or unsolicited communications; and attempting to circumvent security measures.
6. Limitation of Liability
Zidly is provided “as is”. To the fullest extent permitted by Kuwaiti law, Zidly and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is capped at the platform fees you paid in the 12 months before the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Zidly and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from or related to your use of the Services or your breach of these Terms.
8. Termination
We may terminate or suspend your access to the Services at any time, without notice, if we determine that you have violated these Terms. Upon termination, your right to use the Services will immediately cease.
9. Governing Law
These Terms are governed by the laws of the State of Kuwait. Disputes are subject to the exclusive jurisdiction of the courts of Kuwait.
10. Changes to Terms
We may update features, limits, or these Terms. Material changes are announced in-app and by email at least 14 days before they take effect, and we will update the effective date at the top of this page. Your continued use of Zidly after changes take effect means you accept them.
